Companies have been facing difficulties in hiring new foreign workers from abroad due to global travel restrictions arising from COVID-19. To allow companies to tap onto the existing manpower and to be fair to all employers, there are rules to facilitate the change of employers for non-Malaysian Work Permit holders.
Generally, companies who wish to hire your non-Malaysian Work Permit holders must obtain consent for the transfer. However, consent is not needed if the application to transfer the worker is submitted between 21 and 40 days before the expiry of the worker's permit.
Companies submitting Work Permit applications will be asked to declare if written consent has been obtained from the existing employer. Companies must declare truthfully and not make false declarations.
MOM will investigate and take actions against companies found to have made a false declaration. Such companies will be banned from hiring foreign workers, and may also be prosecuted in Court for the offence.
